Terms & Conditions
1. Scope and operator
These Terms of Use govern access to and use of the website aquata.com, operated by aquata Euras Produktions- und Vertriebsgesellschaft mbH, Parkallee 6, 16727 Velten, Germany (“AQUATA”, “we”, “us”).
By using this website you accept these Terms of Use. If you do not accept them, please do not use this website.
2. Intended audience
This website is directed at businesses, public authorities, operators, service stations and other professional users. It is not directed at consumers within the meaning of § 13 BGB. The products presented here are professional protective equipment intended for trained users in commercial, maritime, rescue and defence applications.
3. No binding offer
The presentation of products on this website does not constitute a legally binding offer. Enquiries submitted through this website or by any other means are an invitation to us to submit a quotation. A contract comes into existence only upon our written order confirmation, or upon our performance of the delivery.
Prices are not shown on this website. Quotations are issued individually on request and are valid for the period stated in the quotation.
4. Product information
Technical specifications, illustrations, descriptions, weights, dimensions, material data and performance figures are provided for guidance. They describe the products in general terms and do not constitute a guarantee of specific characteristics within the meaning of § 443 BGB unless expressly agreed in writing.
We reserve the right to make changes arising from ongoing technical development, from changes in materials or from regulatory requirements. Colour representations on screen may differ from the actual product.
Certifications and approvals — including MED, SOLAS and Polar Code — apply only to those products and product versions expressly designated as approved, and only within the scope of the relevant certificate. The binding details are set out in the certificates and documentation supplied with each individual product.
5. Use of the products
Our products are protective and survival equipment. Correct selection of size and specification, proper use, regular inspection and correct maintenance are essential to their protective function. The information on this website does not replace the user manual supplied with each product, nor does it replace the training required for its use.
Servicing, pressure testing and repair must be performed by us or by a trained service station authorised by us. Unauthorised modifications or repairs void any warranty and may impair the protective function of the product.
6. Deliveries and services
Deliveries and services are supplied exclusively on the basis of our General Terms and Conditions of Sale, which are provided with our quotations and order confirmations and form part of the contract. These Terms of Use do not replace them.
7. Export control
Certain of our products, in particular those intended for defence, military and government applications, are subject to national, European and, where applicable, foreign export control legislation. Delivery of such products may require prior authorisation from the competent authorities.
We are entitled to refuse or postpone deliveries where the required authorisations have not been granted, where they are revoked, or where a delivery would infringe applicable export control or sanctions legislation. Any claim for damages arising from such refusal or delay is excluded.
Customers undertake to comply with applicable export control legislation and not to resell or transfer our products in breach of it.
8. Intellectual property
All content on this website — including texts, product descriptions, photographs, illustrations, graphics, videos, logos, layout and design — is protected by copyright and other intellectual property rights and belongs to us or to our licensors.
Reproduction, distribution, public communication, modification or any other use beyond the limits permitted by copyright law requires our prior written consent. Downloading and printing individual pages for your own internal, non-commercial information purposes is permitted, provided that copyright notices are not removed.
AQUATA and [further trademarks — list only those actually registered] are protected designations. No licence to use them is granted by their appearance on this website.
9. Documents and downloads
Manuals, certificates, size charts, catalogues and other documents made available for download are provided for the information of our customers and users. We reserve the right to update them; please ensure you are using the current version. Documents supplied physically with a product take precedence over versions published here.
10. External links
This website contains links to external websites operated by third parties. We have no influence over their content and accept no responsibility for it. At the time the links were set, no infringements were apparent. Responsibility for linked content lies solely with the respective operator. Should we become aware of any infringement, we will remove the link without delay.
11. Availability
We make reasonable efforts to keep this website available, but we do not guarantee uninterrupted or error-free availability. We reserve the right to modify, restrict or discontinue the website or individual functions at any time.
12. Liability
We accept no liability for the accuracy, completeness or currency of the content of this website, nor for damage arising from its use.
This limitation does not apply to liability for damage resulting from injury to life, body or health, to liability for intent or gross negligence, to liability under the German Product Liability Act, or to liability for the breach of material contractual obligations. In the case of a slightly negligent breach of a material contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract.
13. Data protection
Information on how we process personal data is set out in our Privacy Policy.
14. Severability
Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions is unaffected.
15. Applicable law and place of jurisdiction
These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
Where the user is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with the use of this website is Neuruppin, the court competent for our registered seat in Velten.
